Welcome to BookBir, your trusted local booking platform for Bir Billing, Himachal Pradesh.

These Terms & Conditions (“Terms”) govern your access to and use of:

The BookBir Progressive Web App (PWA)
Any future websites, mobile applications, web applications, or digital services operated by BookBir (collectively referred to as the BookBir Services).

By accessing, browsing, installing, or using any BookBir Services, or by making a booking through BookBir, you acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions.

Unless expressly stated otherwise, BookBir does not own, operate, supervise, employ, certify, or control these independent businesses or their services.

BookBir acts solely as a booking facilitator between customers and third-party service providers.

Bookings

A booking request submitted through the BookBir website, Android Application, Progressive Web App (PWA), WhatsApp, telephone, email, or any other official communication channel does not automatically constitute confirmation.

A booking is considered confirmed only when:

The booking has been accepted by the service provider, where applicable;
Any required advance or full payment has been successfully received; and
A confirmation has been issued by BookBir or the respective service provider through email, WhatsApp, SMS, telephone, or another official communication channel.

BookBir reserves the right to decline or cancel booking requests where necessary.

Pricing & Payments

Prices displayed through the BookBir Services are provided for informational purposes and may change without prior notice due to:

Seasonal pricing
Operator pricing
Availability
Government taxes
Special events
Promotional offers

The final booking price will be communicated before confirmation.

Payments are processed through secure third-party payment gateways.

BookBir does not store complete debit card, credit card, or banking information.

User Responsibilities

By using the BookBir Services, you agree that you will:

Provide accurate and complete information.
Follow all applicable laws.
Follow instructions issued by service providers.
Carry valid identification where required.
Arrive on time for booked services.
Respect local communities and the environment.
Behave responsibly toward operators, guides, staff, and other travelers.

You are solely responsible for ensuring that your booking details are correct before making payment.

Adventure Activities

Many activities offered through BookBir involve outdoor adventure and inherent risks.

These activities may include:

Trekking
Camping
Hiking
Adventure Tours
Mountain Activities

Participation in these activities is entirely voluntary.

By making a booking, you acknowledge that:

Adventure activities involve inherent risks.
Serious injury, illness, disability, property damage, or death may occur.
Weather conditions and mountain environments are unpredictable.
Safety depends upon many factors beyond BookBir’s control.

You voluntarily accept these risks.

Medical Fitness

You confirm that:

You are physically and mentally fit to participate.
You have disclosed any relevant medical conditions where required.
You will follow all safety instructions provided by operators.

BookBir shall not be responsible for incidents arising from undisclosed medical conditions or failure to follow operator instructions.

Independent Service Providers

All services available through BookBir are provided by independent third-party operators.

BookBir is not responsible for:

Service quality
Equipment condition
Pilot or guide conduct
Staff behaviour
Safety procedures
Licences or certifications
Operational decisions
Delays
Cancellations
Changes made by operators

Any contractual relationship for the booked service exists between the customer and the respective service provider.

Weather & Operational Conditions

Many outdoor activities are dependent upon weather and operational conditions.

Operators may delay, reschedule, modify, shorten, or cancel activities due to:

Rain
Wind
Poor visibility
Technical issues
Safety concerns
Government restrictions
Natural events
Operational requirements

These decisions are made solely by the operator in the interest of safety.

BookBir shall not be responsible for losses arising from such decisions.

Cancellation & Refunds

Cancellation, modification, and refund requests are governed by the BookBir Refund & Cancellation Policy, which forms part of these Terms & Conditions.

Certain bookings may be subject to individual operator policies.

Users are encouraged to review applicable cancellation terms before confirming a booking.

Insurance

BookBir does not provide travel, medical, personal accident, or adventure sports insurance unless expressly stated.

Users are strongly encouraged to obtain suitable insurance before participating in adventure activities.

Mobile Application & Progressive Web App

The BookBir Android Application and Progressive Web App (PWA) provide access to the same services available through the BookBir website.

By installing or using the Android Application or Progressive Web App (PWA), you agree to these Terms.

The BookBir Android Application and Progressive Web App (PWA):

Do not access Contacts.
Do not access SMS.
Do not access Call Logs.
Do not access Camera.
Do not access Microphone.
Do not access Photos.
Do not access Videos.
Do not access Files.
Do not access Device Storage.
Do not access Clipboard.
Do not access Location.
Do not access personal applications or personal device data,

unless a future feature specifically requires such permission and you have expressly granted it.

BookBir may periodically release updates, bug fixes, security improvements, and feature enhancements.

Intellectual Property

All content available through the BookBir Services, including but not limited to:

Logos
Text
Graphics
Icons
Images
Videos
Website Design
Application Design
Software
Branding

is the intellectual property of BookBir or its licensors and is protected by applicable intellectual property laws.

No content may be copied, reproduced, modified, distributed, or commercially used without prior written permission.

Prohibited Use

Users must not:

Use the BookBir Services for unlawful purposes.
Submit false or misleading information.
Attempt unauthorized access to BookBir systems.
Interfere with website or application security.
Upload malicious software or viruses.
Copy or scrape BookBir content without permission.
Harass or abuse operators, staff, or other users.

Limitation of Liability

Booking errors

Cancellations
Indirect, incidental, consequential, special, or punitive damages

Acts or omissions of independent operators.
Force majeure events.
Reliance upon information published through BookBir.

Where liability cannot legally be excluded, BookBir’s total liability shall not exceed the amount paid by the customer to BookBir for the specific booking giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless BookBir, its owners, employees, affiliates, contractors, and representatives against claims, liabilities, losses, damages, legal costs, or expenses arising from:

Your use of the BookBir Services.
Your violation of these Terms.
Your participation in any activity.
Your violation of applicable laws.
Any dispute between you and an independent service provider.

Force Majeure

BookBir shall not be liable for delays, cancellations, interruptions, or failure to perform obligations resulting from circumstances beyond its reasonable control, including but not limited to:

Natural disasters
Extreme weather
Earthquakes
Landslides
Government actions
Public health emergencies
Strikes
Internet outages
Technical failures
Power failures
Acts of terrorism

Suspension & Termination

Endangers the safety or rights of BookBir, its partners, or other users.

Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of India.

Subject to applicable law, the courts having jurisdiction in Kangra District, Himachal Pradesh, shall have exclusive jurisdiction over disputes arising out of or relating to these Terms & Conditions.
