This Disclaimer applies to the BookBir website, BookBir Android application, BookBir Progressive Web App (PWA), authorised BookBir booking and communication channels, and other digital services operated by BookBir (collectively, the “BookBir Services”).

Please read this Disclaimer together with BookBir’s Terms & Conditions, Booking, Cancellation & Refund Policy and Privacy Policy.

1. General Information

BookBir is a local travel discovery, booking and facilitation platform focused primarily on Bir, Himachal Pradesh and surrounding destinations.

Through BookBir, customers may discover, enquire about or book services such as:

• paragliding and adventure activities;
• hotels, homestays and camps;
• trekking and camping;
• scooty and other vehicle rentals;
• taxi and local transport;
• local experiences;
• customised products and other local services; and
• other travel-related services that may be made available from time to time.

BookBir aims to provide clear and useful information to help customers discover and book local services.

However, travel information, Provider information and operational conditions can change. Information available through BookBir should therefore be read together with the specific details communicated for your booking.

2. BookBir’s Role

BookBir provides a platform through which customers can discover, enquire about and book services offered by BookBir and independent local Service Providers.

Depending on the booking, BookBir may:

• provide information about available services;
• receive booking enquiries;
• check availability;
• communicate prices and booking conditions;
• collect booking information;
• collect a Reservation Amount or other authorised payment;
• coordinate with the relevant Service Provider;
• issue or communicate booking confirmation;
• assist with booking changes or cancellations; and
• provide booking-related customer support.

Unless expressly stated otherwise, the underlying accommodation, activity, transport, rental or other booked service is provided by the relevant independent Service Provider.

BookBir does not become the operator of an independent Provider’s service merely because the service is listed, booked or paid for through BookBir.

At the same time, BookBir remains responsible for its own representations, payment handling, booking administration, express commitments and other obligations for which it is responsible under applicable law.

3. Independent Service Providers

Independent Service Providers may include hotels, homestays, camps, paragliding operators, pilots, trekking guides, vehicle rental providers, taxi operators, drivers and other local businesses or professionals.

Unless expressly stated otherwise, the relevant Service Provider controls the day-to-day delivery and operation of its service.

This may include responsibility for matters such as:

• personnel;
• equipment;
• operational procedures;
• safety decisions;
• property facilities;
• vehicle operation and condition;
• activity operation;
• applicable licences, registrations or permits; and
• compliance with requirements applicable to the Provider’s business.

BookBir may request, review or verify certain information provided by Service Providers. Any such review should not be interpreted as a guarantee that a Provider, activity or service is free from every risk, defect or operational problem.

4. Accuracy of Information

BookBir makes reasonable efforts to provide useful and reasonably accurate information.

However, information concerning services may change, including:

• prices;
• availability;
• operating hours;
• schedules;
• activity duration;
• property facilities;
• room or vehicle availability;
• photographs;
• package inclusions;
• routes;
• weather conditions;
• local conditions; and
• Provider-specific information.

Some information displayed through BookBir is supplied by independent Service Providers.

BookBir may update or correct information when changes or inaccuracies become known.

A listing, displayed price or availability indication does not by itself constitute a confirmed booking.

The material details applicable to a particular booking will be communicated or confirmed as part of the booking process.

5. Local and Travel Information

BookBir may publish local information about Bir and surrounding areas, including information about:

• events;
• attractions;
• road or travel conditions;
• local businesses;
• seasonal conditions;
• weather-related matters; and
• things to do in the area.

This information is provided for general travel-planning purposes.

Local conditions can change quickly, and BookBir does not represent that every piece of local information will be continuously monitored or updated in real time.

Where information is important to your immediate safety, travel route or travel decision, you should also consider current information from the relevant authority, Provider or other appropriate source.

6. Adventure and Outdoor Activities

Certain services available through BookBir involve outdoor or adventure activities, including paragliding, trekking, camping and hiking.

Such activities involve inherent risks that cannot always be eliminated completely.

Depending on the activity, these may include risks associated with:

• weather and wind;
• altitude;
• terrain;
• physical exertion;
• changing environmental conditions;
• transportation;
• equipment;
• slips, falls or other accidents; and
• circumstances inherent in outdoor and adventure activities.

Participation in such activities is voluntary.

Customers should understand the nature of the activity, comply with applicable eligibility requirements and follow the safety instructions provided by the relevant operator, pilot, guide or other responsible person.

Acknowledging the inherent risks of an adventure activity does not mean that a customer waives rights or remedies that cannot lawfully be waived.

In particular, nothing in this Disclaimer is intended to excuse negligence, fraud, deliberately unsafe conduct, defective equipment or other conduct for which responsibility cannot lawfully be excluded.

7. Weather and Operational Conditions

Outdoor and adventure activities may depend heavily on weather, terrain, road, airspace and other operational conditions.

For safety or operational reasons, a Service Provider may need to:

• delay an activity;
• change its start time;
• alter a route;
• shorten or modify an activity;
• reschedule it; or
• cancel it.

For example, paragliding flight duration and operation may be affected by wind, weather, thermal conditions, visibility, air traffic and safety considerations.

Operational safety decisions are generally made by the relevant Provider, pilot, guide or other appropriately responsible person.

BookBir cannot guarantee suitable weather or that a weather-dependent activity will operate at a particular time.

Where an activity cannot be provided or is materially changed, any rescheduling, alternative or refund will be handled in accordance with the applicable booking conditions and BookBir’s Booking, Cancellation & Refund Policy.

8. Activity Duration and Experience

Any activity duration, route, height, distance, itinerary or similar operational information displayed by BookBir may be approximate unless expressly guaranteed.

Actual conditions may cause reasonable variations.

For example, the actual flying time of a paragliding flight may vary according to weather, wind, thermal activity, air traffic, safety considerations and other flying conditions.

A reasonable variation caused by genuine operational or safety considerations does not necessarily mean that the booked service was not provided.

Where a change materially alters the essential service purchased, the matter will be considered under the applicable booking conditions, BookBir’s policies and applicable law.

9. Personal Responsibility and Eligibility

Customers are responsible for:

• providing accurate booking information;
• complying with communicated eligibility requirements;
• carrying required identification;
• holding a valid driving licence where required;
• arriving at the communicated place and time;
• following lawful and reasonable safety instructions;
• using required safety equipment; and
• complying with applicable laws and local regulations.

Some activities may have requirements concerning age, weight, health, physical condition or other eligibility criteria.

Where relevant, customers should disclose information reasonably requested by the Service Provider for determining eligibility or safe participation.

A Provider may refuse participation where a customer does not meet an applicable eligibility or safety requirement.

10. Health and Medical Matters

BookBir does not provide medical advice and does not independently determine whether a particular activity is medically suitable for an individual.

Customers with a medical condition, recent injury, pregnancy or other health concern that could affect participation should seek appropriate medical advice where necessary and inform the relevant Provider where the information is reasonably required for safe participation.

The final operational decision on participation may be made by the relevant Provider where safety requirements apply.

Nothing in this section permits discrimination contrary to applicable law.

11. Accommodation Information

Information concerning accommodation may include descriptions of:

• rooms;
• facilities;
• meals;
• parking;
• views;
• check-in and check-out;
• property rules;
• photographs; and
• other amenities.

Properties may change facilities or arrangements from time to time.

BookBir will make reasonable efforts to communicate material information relevant to a booking.

Customers should rely on the details confirmed for their particular booking rather than assuming that every general photograph, description or feature applies to every room, date or rate.

12. Vehicle Rentals and Transport

Vehicle rental and transport services are normally provided by independent rental Providers, taxi operators or drivers.

Customers using rental vehicles are responsible for complying with applicable driving laws, licence requirements and the agreed rental conditions.

Travel times and route estimates are not guaranteed and may be affected by:

• traffic;
• weather;
• road conditions;
• road closures;
• landslides;
• diversions;
• government restrictions; and
• other circumstances outside reasonable control.

Any applicable deposit, damage responsibility, fuel policy, waiting charge, toll or other material condition will be communicated as part of the booking arrangement where relevant.

13. Prices and Availability

Prices and availability displayed or communicated through BookBir may change until a booking is confirmed.

A booking request does not itself guarantee:

• availability;
• a particular Provider;
• a particular room or vehicle;
• an activity time; or
• a displayed price where the price was expressly stated to be indicative or subject to availability.

The applicable price and material conditions will be communicated before payment or confirmation as appropriate.

Once a booking has been confirmed, the accepted price and conditions apply subject to any subsequently agreed change and applicable law.

14. Booking Confirmation

Submitting an enquiry, selecting a service or receiving an availability response does not necessarily mean that the booking is confirmed.

Unless expressly stated otherwise, a booking becomes confirmed when the required Reservation Amount or other required payment has been successfully received and BookBir or the authorised Service Provider has issued a Booking Confirmation.

Customers should review their confirmation and promptly notify BookBir of any material error.

15. Cancellation, Changes and Refunds

Cancellation, rescheduling, Provider cancellation, no-show, failed payment and refund matters are governed by:

1. the specific conditions disclosed and accepted for the booking;
2. BookBir’s Booking, Cancellation & Refund Policy; and
3. applicable law.

Material cancellation conditions applicable to the booking will be communicated or made reasonably accessible before payment.

A Provider’s cancellation or inability to supply a confirmed service is not automatically treated as a customer cancellation.

BookBir will not retrospectively impose a less favourable cancellation condition than the one properly disclosed and accepted for the booking.

16. External Websites and Third-Party Services

BookBir may link to or use services provided by third parties, including payment processors, maps, messaging platforms, social media services, app stores and Service Provider websites.

These independent services may have their own:

• terms;
• privacy practices;
• security measures;
• availability; and
• technical requirements.

BookBir does not control the operation of independent third-party websites or services merely because they are linked from or integrated with BookBir.

Customers should review applicable third-party terms where appropriate.

17. Website, App and Technical Availability

BookBir aims to keep its website, applications and digital booking services reasonably available.

However, temporary interruptions may occur because of circumstances such as:

• internet or mobile-network failures;
• hosting or server problems;
• maintenance;
• software updates;
• device or browser compatibility;
• third-party service interruptions; or
• technical issues outside BookBir’s reasonable control.

BookBir does not guarantee uninterrupted access to every digital feature at all times.

A temporary interruption to BookBir’s website or application does not by itself cancel an already confirmed booking.

18. Privacy and Device Permissions

Personal information provided through BookBir is handled in accordance with BookBir’s Privacy Policy and applicable law.

The BookBir application or website may use device features or permissions where necessary for a feature and where permitted by the user.

The specific categories of personal information collected, purposes of processing, sharing, retention and applicable user rights are described in BookBir’s Privacy Policy and relevant notices.

BookBir will not treat this Disclaimer as a substitute for the privacy notices or permissions required under applicable law.

19. No Professional Advice

General information published through BookBir is not intended to constitute professional:

• medical advice;
• legal advice;
• financial advice;
• insurance advice; or
• professional safety advice.

Where your circumstances require such advice, you should consult an appropriately qualified professional.

Travel recommendations and local information provided by BookBir are intended to assist with planning and should be considered together with current conditions and your own circumstances.

20. Responsibility and Liability

Responsibility for a problem depends on the circumstances and on which party was responsible for the relevant act, omission or obligation.

BookBir is responsible for its own acts and omissions to the extent required by applicable law.

Independent Service Providers are responsible for their own service delivery, operational decisions and acts or omissions to the extent required by applicable law.

BookBir is not responsible merely because an independent Provider caused a loss outside BookBir’s reasonable control.

However, this does not exclude any responsibility BookBir may have arising from its own:

• representations;
• negligence;
• payment handling;
• booking administration;
• express commitments; or
• other legally attributable conduct.

To the maximum extent permitted by applicable law, BookBir will not be responsible for indirect or consequential loss that was not reasonably foreseeable as a result of BookBir’s breach.

Nothing in this Disclaimer excludes or limits any liability, consumer right or remedy where doing so would be prohibited by applicable law.

21. Events Beyond Reasonable Control

BookBir or a Service Provider may occasionally be prevented from performing a booking because of exceptional circumstances outside reasonable control.

Depending on the circumstances, these may include:

• severe weather;
• natural disasters;
• landslides;
• major road closures;
• government restrictions;
• airspace restrictions;
• public emergencies;
• significant infrastructure failures; or
• other events that genuinely prevent performance.

Such an event does not automatically mean that all money paid by a customer is forfeited.

Any rescheduling, alternative, refund or other outcome will be considered in accordance with the service affected, applicable booking conditions, amounts properly committed or already provided, and applicable law.

22. Insurance

Unless expressly stated as included for a particular booking, BookBir does not itself provide travel, medical, personal accident or adventure-sports insurance.

Customers should consider whether appropriate insurance is suitable for their trip and planned activities.

Where a Service Provider states that insurance applies to a particular service, the scope, exclusions and conditions of that insurance are determined by the relevant insurance documentation.

BookBir does not represent that Provider insurance covers every possible incident, customer or loss.

23. No Absolute Guarantee

BookBir does not guarantee that:

• every service will remain available indefinitely;
• weather will be suitable for an activity;
• travel will be free from disruption;
• every Provider will deliver an identical customer experience;
• digital services will operate without interruption; or
• circumstances outside reasonable control will never affect a booking.

This section does not reduce BookBir’s responsibility for a confirmed booking or representation where responsibility arises under the accepted booking conditions or applicable law.

24. Relationship With Other BookBir Policies

This Disclaimer should be read together with BookBir’s:

• Terms & Conditions;
• Booking, Cancellation & Refund Policy;
• Privacy Policy; and
• specific conditions communicated for an individual booking.

If this Disclaimer conflicts with a specific booking condition that was properly disclosed and accepted before payment, the specific booking condition will generally govern that booking, subject to applicable law.

For cancellation and refund matters, the applicable booking-specific conditions and BookBir’s Booking, Cancellation & Refund Policy apply, subject to applicable law.

Nothing in this Disclaimer overrides a mandatory right or remedy available under applicable law.

25. Changes to This Disclaimer

BookBir may update this Disclaimer to reflect changes to its services, business practices or applicable requirements.

The current version will be published with an updated date.

Changes to this general Disclaimer will not ordinarily be used retrospectively to remove a material right that has already arisen under an existing confirmed booking.

26. Governing Law

This Disclaimer is governed by the laws of India.

Nothing in this Disclaimer limits any mandatory consumer right, remedy, jurisdiction or statutory forum available under applicable law.

28. Acceptance

By using BookBir or making a booking through BookBir, you acknowledge that you have had the opportunity to review this Disclaimer and the terms applicable to your booking.

You understand that:

• many services available through BookBir are provided by independent Service Providers;
• travel and outdoor activities may be affected by weather and other changing conditions;
• adventure activities may involve inherent risks;
• BookBir cannot guarantee matters outside its reasonable control; and
• this Disclaimer does not remove any right or remedy that cannot lawfully be excluded.
